Thank you for shopping at Marisa Sianne Arts. This policy applies to goods purchased directly through our website (www.marisasianne.art) and does not cover third-party purchases or commissioned works. Please also see our Commission Policy if relevant.

 

Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of this Store Policy:

  • Company / We / Us / Our: Marisa Sianne, of Marisa Sianne Arts, 13 Cornish Crescent, CV10 7JD.

  • Goods: Items available for immediate sale on the Website.

  • Orders: Your request to purchase Goods from Us.

  • Service: Any additional offering labeled as a service on the Website.

  • You / Your: The individual or entity accessing or using the Service.

1. Your Right of Withdrawal

Original and Custom Artwork:

All original artworks and custom artworks are final sale. They cannot be returned or cancelled unless they are damaged or significantly different from the description.

Printed or Standard Goods:

You may cancel your order within 14 days of receiving the Goods, in line with UK consumer law.

How to Cancel:

To exercise your right of cancellation (for printed or standard goods), notify Us via contact link with a clear statement of your decision.

Cancellation does not apply to:

  1. - Goods made to your specifications or clearly personalized.

  2. - Perishable or rapidly deteriorating items.

  3. - Sealed goods unsuitable for return due to hygiene or health reasons once unsealed.

  4. - Goods inseparably mixed with other items.

Significant Issues:

If the Goods are damaged, lost, or significantly different from their description, you may follow the return process regardless of type.

2. Postage and Dispatch

All orders are packed and dispatched from my studio.

Dispatch timeframes vary by item type and are provided as estimates only; During periods of high demand, larger quantity orders, or where materials require replenishment, dispatch may take up to 4 weeks. Orders may be dispatched sooner where possible.

  • Original works and commissions: 10–14 working days

  • Prints and smaller goods3–5 working days

  • Pre-orders, or custom adjustments: 1-4 weeks

PLEASE NOTE: Dispatch estimates exclude weekends and public holidays. Orders containing multiple product types will be dispatched according to the longest applicable timeframe.

  • Postage costs are calculated at checkout. Additional postage may be required for oversized, framed, or higher-value works to ensure safe delivery; this will be communicated prior to dispatch.

  • Orders are sent via tracked delivery and/or specialist courier services appropriate to the artwork; courier services that do not provide suitable artwork coverage are not used.

  • Orders containing pre-order items or custom adjustments will be dispatched together according to the longest applicable timeframe unless separate arrangements have been agreed in advance.

Customer Responsibility:

  • Customers are responsible for ensuring all delivery details are correct at checkout.

  • If an error is identified, please contact me as soon as possible; changes can only be made prior to dispatch and cannot be amended once dispatched.

3. Loss and Damages of Goods

Shipping Care: 

All Goods are carefully packed to ensure safe delivery; however, damage or loss may occur during transit.

Reporting Damage:​

  • Contact Us within 7 days of receiving the Goods if they arrive damaged.

  • Provide the following:

  1. Order number and tracking reference.

  2. Photos of the damage and packaging.

  3. Description of the issue and total value affected.

  • Claims made after 7 days of receipt may be considered invalid, except in exceptional circumstances where timely inspection was not reasonably possible.

Lost Goods:

  • If an Order does not arrive, notify Us within 7 days of the estimated delivery date.

  • If the courier confirms the item is lost, we will refund 100% of your purchase and provide a 10% discount code for future use.

Customer Responsibility:

  • Ensure delivery details are accurate.

  • Take reasonable steps to secure the Goods upon delivery (e.g., safe place, leaving with a neighbour).

Please note We are not liable for damages or loss resulting from incorrect information or negligence, including after delivery.

​​4. Terms and Conditions for Returns

Original and Custom Artwork:

  • All original artworks and custom artworks are final sale. They cannot be returned or cancelled, except if they arrive damaged or significantly different from the description.

Printed or Standard Goods:

  • You may return these within 14 days of receipt, with all original packaging, including certificates where applicable. Return shipping costs are your responsibility, unless the item is damaged or incorrectly described. We can organise return shipping at our discretion; costs may apply.

Damaged or Incorrect Items:

  • We will organise the return shipment ourselves at no cost to you.​

Non-returnable Goods:

  1. Personalized or custom-made items.

  2. Goods listed as faulty/flawed in the description.

  3. Goods unsuitable for return due to hygiene, rapid deterioration, or inseparable mixing.

  • Returns are at your cost and risk.

  • We recommend insured, trackable shipping, such as Royal Mail.

  • Refunds require proof of return or receipt.

  • We reserve the right to refuse returns of any Goods that do not meet the above return conditions in Our sole discretion.

5.Refunds and Replacements

Depending on the type of goods purchased, this is subject to refund or replacement depending on the type of product bought:

  • Damaged/Incorrect Goods:

A full refund issued upon safe return of the item.

 

  • Change-of-Mind Returns:

Each returned item is eligible for a single replacement, exchange, or refund. Upon successful receipt of returned goods, you may choose one of the following:

  1. An equal-value replacement (if in stock, with free shipping).

  2. A gift voucher of equal value.

  3. A full refund for the Goods only (excluding original shipping), unless we choose to organise the return shipment.

Refund Timeline:

  • Refunds will be processed within 14 days of us receiving the returned Goods, using the same payment method. Please note that it may take additional time for your bank or payment provider to reflect the refund.

Exceptions:

  • Sale items or items with pre-existing flaws cannot be refunded, except where your statutory rights under UK law apply.
